As a part of the operation of the Trade Wind Equipment Exchange, a Nevada corporation (Trade Wind), website and the services Trade Wind offers, Trade Wind collects certain information about its registered users and about visitors to the Site. This Privacy Policy describes the information Trade Wind collects both about registered users and about visitors, and what Trade Wind does with the information collected. By accessing the Trade Wind website, both registered users and visitors agree to the terms of this Privacy Policy.

To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
Collection and Use of Information of Registered Users
At the time of registration as a user, each registered user is required to provide certain personal information including but not limited to company name, names of authorized users, email addresses, telephone numbers, and address. In addition, during a registered user's use of the Trade Wind website, Trade Wind may collect information about the user's buying and selling behavior, and the user itself may provide other information such as descriptions of assets, business location, business description and other data related to the activities being conducted. The personal and other information described above shall be stored by Trade Wind and used only by Trade Wind (1) to contact registered users during and after the process in which the user is participating, (2) to provide the registered user with periodic marketing and promotional notices, (3) to notify the user of changes to Trade Wind policies or website features or functions. We also use personally identifiable information about registered users to improve our marketing efforts, to statistically evaluate site usage, to improve our site and offerings and to customize our site's content, layout, and services. We may also use personally identifiable information to deliver information to users that, in some cases, are targeted to their interests, such as targeted banners, new services and promotions.
Registered users may elect to opt out of certain of the mailing lists or notification services provided by Trade Wind. However, Trade Wind requires registered users to provide adequate contact information in connection with their use of the website, so failure to provide the information requested at time of registration can result in denial of access to the website. An individual who is an authorized user may request that Trade Wind delete or otherwise cease use of the personal information of that individual by contacting operations@tradewindequipment.com.
Trade Wind backs up its systems. Therefore a registered user should not expect that all personal identity information will be completely removed from Trade Wind's databases in response to a request.
Each registered user is responsible for ensuring that the information provided to Trade Wind by that user is accurate and current. Users may correct inaccuracies in the information maintained by Trade Wind by editing their User profiles or by contacting marketplace@tradewindequipment.com. After a correction is made, upon request by a user, Trade Wind will provide updated information to any service provider or other third party to whom Trade Wind has previously sent user information as set forth below.
Site Usage Information and Cookies
The Trade Wind Site automatically tracks certain information about registered users and visitors based upon behavior upon the website. The information may include the URL the user or visitor came from, which URL the user or visitor visits next, what browser the user or visitor is using, and the IP address of the user or visitor. Trade Wind compiles this information and uses the information for internal research in order to better understand and serve its users.
Trade Wind uses web browser cookies (data files stored on a user's or visitor's hard drive) on a limited basis, and only to store certain "state" information such as the user's identity code and session identifiers. Since cookies are stored in human-readable form, Trade Wind does not store other data such as passwords, preferences, etc. in cookie files. The website will not read cookies from a user's cookie file other than those placed there through the user's web browser's interaction with the Site.
Disclosure of User Information
As a general matter, Trade Wind does not sell, rent or transfer any personally identifiable information (including name, address, telephone number or email address) about registered users or authorized individual users to any third party. Trade Wind does not collect personally identifiable information about visitors to its site, but tracks site usage by visitors as set forth above. Information provided by registered users, as well as site usage information, may be disclosed to third parties in aggregate form, without the identification of personally identifiable information.
The following are some of the ways the information provided by registered users, including personally identifiable information, or site usage information may be disclosed to third parties:
1. Other Users. As described in the User Agreement, if a registered user posts an item to be sold and allows inspection of the item, other registered users wishing to bid upon the item may contact Trade Wind and obtain information about the seller including name, address, email address and telephone number to facilitate inspections and other sale-related communications.
2. Other Users and Visitors. The Trade Wind website is designed such that registered users are not identified by personally identifiable information. However, in postings to the site, a registered user may voluntarily post personally identifiable information such as email address, company name or other contact information. As a result, other users or visitors to the site may send such a user unsolicited email or be able to identify some or all of that user's activities on the site.
3. Legal Requests. Trade Wind complies with law enforcement-related requests and the requests by other third parties to enforce laws, intellectual property rights and other rights.
4. Third Party Service Providers. Trade Wind contracts with third party service providers (e.g., shipping, financial services) in order to facilitate the services offered by Trade Wind. Registered users may choose to use these optional services by indicating their consent to a referral and transfer of their information over the site, and in this case, Trade Wind will by necessity provide personally identifiable information to the third party service provider offering the desired services. Before Trade Wind provides any information about a registered user, the user will be given the opportunity to see the data which will be sent to the third party service provider. Because Trade Wind does not control the privacy practices of third party service providers, registered users should evaluate the practices of such providers before deciding to use their services.
5. Suppliers. We may use third party suppliers and service providers to facilitate our services. For example, we may outsource the operations of one or more aspects of our site to a supplier or service provider who performs services according to our requirements. In some instances, the service provider may collect information directly from registered users. In these cases, users will be notified of the involvement of the supplier or service provider, and all information disclosures users make will be strictly optional. In all cases, we restrict how these suppliers and service providers may access, use and disclose the information of registered users. In general, we do not permit these suppliers and service providers to sell your information to third parties.
6. Strategic Partners. Trade Wind will share information provided by registered users and visitors with its strategic partners. To the extent that these entities are obtaining personally identifiable information, they will treat it at least as protectively as Trade Wind.
7. Unintended Disclosure. The measures Trade Wind uses to safeguard the confidentiality of personally identifiable information, such as firewalls and secure socket layers, conform to industry standards. However, there are no guarantees of security on the Internet, and third parties may unlawfully intercept or access information provided by registered users or visitors. In addition, Trade Wind must adapt to a continually changing regulatory environment and cannot ensure that personally identifiable information will never be disclosed in response to government or other regulatory authorities in ways not anticipated by this Privacy Policy.
By accepting the Site Usage Rules, registered users expressly consent to the terms for disclosure of their information as described above. By accessing the website, visitors consent to the terms for disclosure of their information as described above.
European Union
Users or visitors residing in the European Union and providing to Trade Wind “personal data” as defined in the Directive on the Protection of Individuals with regard to the Processing of Personal Data and on the Free Movement of Such Data explicitly consent to the collection and processing of their personal data in the United States.
Other Information Collectors
Except as otherwise expressly set forth herein, this Privacy Policy only addresses the use and disclosure of information Trade Wind collects from registered users and visitors. To the extent a registered user or visitor discloses information to other parties such as advertisers, other users, third party service providers or parties to which the Trade Wind website is linked, different rules apply to their use or disclosure of the information Trade Wind users or visitors disclose to them. Trade Wind does not control the privacy policies of third parties and cannot be held responsible for the disclosure or use of information by such parties.
